General Terms and Conditions (GTC)

Tsubaki Beauty UG (haftungsbeschränkt)

§ 1 Provider and Scope

These GTC apply to all orders placed through the online shop of Tsubaki Beauty UG

(haftungsbeschränkt), Schlehenweg 10, 85757 Karlsfeld, Germany, care@tsubakibeauty.com. A

consumer is any natural person acting for purposes outside their trade, business or profession.

§ 2 Conclusion of Contract

Product presentations are non-binding invitations to order. By clicking the purchase button, the

customer submits a binding offer. The contract is concluded upon order confirmation or dispatch of

goods. Contract language is German; English versions are provided for convenience.

§ 3 Prices, Shipping and Delivery

All prices include applicable VAT. Orders are usually processed within 1–3 business days. Delivery

estimates: Germany 2–5 business days; EU 3–8 business days. Delivery times are estimates only.

Delays caused by carriers, customs, weather, strikes or circumstances beyond our control may

occur. Incorrect addresses may result in additional shipping charges for reshipment.

§ 4 Payment Methods

Payments may be processed via Shopify Payments, PayPal, Klarna, Visa, Mastercard, Apple Pay,

Google Pay and other methods displayed at checkout.

§ 5 Retention of Title

Goods remain the property of Tsubaki Beauty UG (haftungsbeschränkt) until full payment has been

received.

§ 6 Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. Customers may use the withdrawal

button, withdrawal form, or another clear declaration. Refunds may be withheld until returned goods

or proof of return are received. Customers bear direct return shipping costs unless otherwise

required by law. Sealed cosmetic, skincare and personal care products that have been opened or

unsealed after delivery are excluded from withdrawal rights under §312g para.2 no.3 BGB unless

defective, damaged on arrival, or incorrectly delivered.

§ 7 Damaged, Defective or Incorrect Items

Customers should inspect deliveries promptly and report visible transport damage as soon as

possible, preferably within 48 hours. Delayed reports may limit investigation options with the carrier.

Original packaging should be retained until the case is resolved.

§ 8 Refund Process

Approved refunds are issued to the original payment method. In the case of a partial return, if the

remaining order value falls below the applicable free-shipping threshold, Tsubaki Beauty reserves

the right to deduct the standard shipping charge that would have applied to the retained items. This

does not affect statutory withdrawal rights.

§ 9 Warranty

Statutory warranty rights apply. Legitimate warranty claims should be submitted to

care@tsubakibeauty.com.

§ 10 Liability

Tsubaki Beauty is fully liable for injury to life, body or health. For other damages, liability is limited

as permitted by law. Tsubaki Beauty is not liable for delays caused by carriers, customs, weather,

strikes or circumstances beyond its reasonable control. Mandatory consumer rights remain

unaffected.

§ 11 Data Protection

Personal data is processed in accordance with the Privacy Policy available on the website.

§ 12 Online Dispute Resolution

The European Commission provides an ODR platform. Tsubaki Beauty is not obligated and not

willing to participate in consumer arbitration proceedings unless legally required.

§ 13 Final Provisions

German law applies excluding the CISG. If any provision is invalid, the remaining provisions remain
